Which one is it?

The United States passed a law about TikTok because lawmakers and national security officials warned that its parent company ByteDance's ties to China are national security risks, and that the Chinese government could access TikTok data to spy on Americans. The Protecting Americans from Foreign Adversary Controlled Applications Act was signed into law by President Joe Biden on 24 April 2024. It lets the president prohibit certain apps under the jurisdiction of US unless they are within 270 days, and it explicitly applies to ByteDance and TikTok.

Why the worry? TikTok had more than 150 million monthly users in the United States as of March 2023. Concerns have also been raised about China's 2017 National Intelligence Law, an article of which says that all organizations and citizens shall support, assist and cooperate with national intelligence efforts.

Others see less evidence. The Associated Press reported that, as of March 2023, there was no evidence that TikTok had turned over personal data relevant to China's national security to the Chinese government, and the United States has not offered any evidence of TikTok sharing such information. Critics of the act say a forced sale may violate the and that comprehensive privacy legislation would be more appropriate. China's Foreign Ministry said the bill put the United States on the opposite side of fair competition.

The upheld the law on 17 January 2025. Enforcement was then delayed more than once by executive orders, and on 22 January 2026 a deal closed under which TikTok's US operations moved to a , in which ByteDance holds 19.9%.

Recap

The law targets who controls an app's data: supporters cite national security risks, critics point to the lack of public evidence and to free speech.

💡 A trick to remember it · Sell or be shelved: the law said the app's owner must change, and the debate was whether the danger was proven or only possible.

Surprising fact · TikTok briefly shut down in the US on 18 January 2025 before enforcement was delayed.
